{"id":24742,"date":"2023-03-20T13:00:03","date_gmt":"2023-03-20T12:00:03","guid":{"rendered":"https:\/\/www.agrosmartglobal.eu\/?p=24742"},"modified":"2023-03-20T13:10:16","modified_gmt":"2023-03-20T12:10:16","slug":"the-practical-guide-on-the-protection-of-geographical-indications-on-the-internet-has-been-published","status":"publish","type":"post","link":"https:\/\/www.agrosmartglobal.eu\/en\/2023\/03\/20\/the-practical-guide-on-the-protection-of-geographical-indications-on-the-internet-has-been-published\/","title":{"rendered":"The &#8220;Practical Guide on the protection of Geographical Indications on the Internet&#8221; has been published"},"content":{"rendered":"\n<p>The guide entitled &#8220;The protection of Geographical Indications on the Internet&#8221;, version 2023, which was prepared within the framework of AGROSMARTglobal, is now available for reading and downloading.<\/p>\n<p>The guide corresponds to the objective of the project to strengthen the competitiveness, promotion and internationalization of agri-food cooperatives and SMEs in the rural areas of Sudoe in the digital market (Sudoe = Southwestern Europe, including Spain, Portugal and the French regions Nouvelle-Aquitaine and Occitanie).<\/p>\n<p>Regarding the development of the guide,&nbsp;AREPO\u2019s missions, in collaboration with the Universidade de Tr\u00e1s-os-Montes e Alto Douro \u2013&nbsp;UTAD, was to provide tools to producer groups and agri-food cooperatives in the Sudoe in order to strengthen the&nbsp;<strong>promotion&nbsp;<\/strong>and&nbsp;<strong>protection<\/strong>&nbsp;of their products benefiting from European quality schemes (PDO, PGI, TSG and organic farming) on the&nbsp;<strong>international digital market<\/strong>.<\/p>\n<p>UTAD was responsible for activities aimed at strengthening the promotion of products benefiting from European quality systems on the Internet, and&nbsp;<span class=\"color\">AREPO was responsible for activities aimed at&nbsp;<strong>strengthening the protection of Geographical Indications (GIs) on the Internet<\/strong><\/span>.<\/p>\n<p>AREPO has noted the lack of clear and concrete information on the existing means of protecting GIs on the Internet and has therefore decided to draw up a&nbsp;<strong><span class=\"color\">practical guide<\/span><\/strong>&nbsp;with the aim of&nbsp;<span class=\"color\">providing operational tools<\/span>&nbsp;for the holders and legitimate users of geographical indications, in other words, GI producer groups and their members.<\/p>\n<p>GIs, and more particularly PDOs and PGIs, occupy an important place in terms of exports for the countries of the European Union and are particularly affected by&nbsp;<strong>counterfeiting<\/strong>&nbsp;and&nbsp;<strong>cybersquatting<\/strong>&nbsp;because of their reputation and attractiveness, which are attracting&nbsp;<strong>growing interest from third parties<\/strong>.<\/p>\n<p>Therefore, professionals who are legitimate holders of geographical indications must develop a&nbsp;<strong>complete<\/strong>,&nbsp;<strong>prudent and exhaustive defence strategy<\/strong>, in order to take advantage of the undeniable benefits of an Internet presence, while minimising the risks of infringements, which are often complex to contain.<\/p>\n<p>This guide thus aims to provide&nbsp;<span class=\"color\"><strong>deciphered<\/strong>&nbsp;and&nbsp;<strong>clarified<\/strong>&nbsp;information<\/span>&nbsp;on how the Internet works in terms of intellectual property law and to present the&nbsp;<span class=\"color\"><strong>concrete steps<\/strong>&nbsp;to be taken<\/span>&nbsp;to effectively protect one\u2019s GI from an infringement on the Internet.<\/p>\n<p>To carry out its work, AREPO called on experts and practitioners in intellectual property, specialised in French, Spanish and Portuguese regulations, i.e. the three countries covered by the project (Sudoe area).<\/p>\n<p>The guide focuses more particularly on the&nbsp;<strong><span class=\"color\">procedures applicable to France<\/span><\/strong>, with some insights into the&nbsp;<span class=\"color\">specific cases of&nbsp;<strong>Spain&nbsp;<\/strong>and&nbsp;<strong>Portugal<\/strong><\/span>.
